Privacy Policy — Brandquatch

1. Data controller

Werner Fett Studio SpA ("WFS", "we"), Chilean Tax ID / RUT 78.235.434-5, domiciled at El Trovador 4280, office 307, Las Condes, Santiago, Chile, is responsible for the processing of personal data it collects through Brandquatch (brandquatch.com).

2. What data we collect

Data you give us directly:

• Email address and password (when you sign up).
• Name, brand information (industry, team size, website, social media) you enter during Onboarding or the Diagnostic.
• Answers to the Brand DNA-building questionnaire.
• Text or image pieces you upload to the Reviewer.
• Contact information you leave on the waitlist or similar forms.

Data we collect automatically:

• Basic usage data (which features you use, when).
• Cookies strictly necessary to keep you signed in and remember your theme (light/dark) and language preference. We don't use advertising-tracking cookies or share them with ad networks.

Data we look up with your authorization (Audit feature):

• When you use the Audit feature, we search and read public content about your brand (your declared website, mentions, and public presence) to compare it against what you declared. This is limited to information already public on the internet.

We don't collect sensitive data (health, ethnic origin, political/religious affiliation, etc.) unless you voluntarily include it in the content you upload — avoid including this type of information in your pieces or answers.

3. What we use your data for

• To provide the Service: building your Brand DNA, evaluating pieces, and generating diagnostics and audits applying Werner Fett Studio's criteria and methodology.
• Managing your account and authentication.
• Sending you operational communications (account confirmation, service notices) and, if you authorize it, product communications.
• Billing, when applicable to a paid plan.
• Improving the Service (in aggregated/anonymized form when possible).

We do not sell your personal data to third parties.

4. Legal basis

We process your data because: (a) it is necessary to perform the service contract you accept when creating an account, or (b) you give us your explicit consent (for example, when connecting external evidence for Audit), as applicable to each specific processing activity.

5. Who we share your data with

We use external providers to operate the Service, each with access limited to what's strictly necessary for their function:

International transfers: some of these providers (including Anthropic) process data on servers outside Chile, mainly in the United States. By using the Service, you accept this transfer, which is necessary for the product to work.

We don't share your data with third parties for marketing purposes unrelated to Brandquatch.

6. How long we keep your data

We retain your data while your account is active. If you delete your account, your personal data and brand content are effectively deleted within 30 days of the request, except for information we must retain due to legal obligation — for example, billing records, which under Chilean tax regulations must be kept for 6 years.

7. Your rights (ARCO)

Under Chilean law (Law 19.628 and Law 21.719), you have the right to:

• Access the personal data we hold about you.
• Rectify inaccurate or outdated data.
• Cancel (delete) your data, subject to legal retention obligations.
• Object to a specific processing of your data.
• Additionally, under Law 21.719: the right to data portability and to not be subject to decisions based solely on automated processing that significantly affect you without the possibility of human review.

If you believe we have not adequately resolved your request, you can file a complaint with Chile's Personal Data Protection Agency.

8. Security

We apply reasonable technical and organizational measures to protect your data (encryption in transit, access control, data isolation per organization). No system is 100% secure; if a data breach affecting you occurs, we will notify you as required by law.

9. Minors

The Service is not directed at minors under 18. We do not knowingly collect data from minors.

10. Changes to this policy

We may update this Policy. Substantial changes will be communicated with reasonable advance notice by email or notice on the platform.
